'The website' refers to www.researchiscool.com (or Research is Cool), regardless of the ways in which you have accessed it. The term 'advertiser' refers to university departments, schools, faculties or any other organisations that have posted jobs, courses, or banners on www.researchiscool.com 'User' refers to anyone who visits www.researchiscool.com regardless of how they have accessed the site; this category includes visitors browsing the site as well as visitors who register their research profile on our research network (R-Net).
By using the website in any way, you are deemed to have read and accepted these Terms and Conditions. Also, by completing the initial registration form and by entering your email address and password you are deemed to have read and accepted these Terms and Conditions.
If you register with Research is Cool you should also read our Privacy Policy, which is part of our Terms and Conditions.
1. Basis of Terms and Conditions
These Terms and Conditions shall apply to the exclusion of any terms or conditions put forward by or on behalf of any Research is Cool users, including advertisers. No alteration of these conditions shall be effective unless expressly agreed to in writing by Research is Cool.
2. Use of material
You can download, print and copy material from the site for your own personal use. You must not reproduce any part of the site or the material unless we have granted you permission to do so. Permission can be sought from info@researchiscool.com
3. Registration
When you register, you are registering as an personal user of Research is Cool. Access to the registration areas is via your email address and password. We allow you to access the registration areas of the site on the basis that you will comply with these Terms and Conditions, you will not do anything which will assist anyone who is not a registered user to gain access to the registration areas of the website, and that you do not maliciously create registration accounts for the purpose of abusing the functionality of the website. If, for any reason, we believe that you have not complied with these requirements, we reserve the right to cancel your access to the registration areas of Research is Cool immediately and without giving you any advance notice, block your IP address and email address from accessing the site, and inform your internet service provider of illegal activity.
4. Disclaimer of liability
4.1 External websites
You can access other websites via links from www.researchiscool.com. These sites are not under our control and we are not responsible in any way for their content.
4.2 Information provided by advertisers
A large part of the information on the website is provided directly by advertisers. As an advertiser, you are solely responsible for the content of the advertising material you submit to us, including that it complies with relevant legislation. Research is Cool does not accept responsibility or liability for the content of the material provided by advertisers, including any error, omission or inaccuracy therein.
4.3 Indemnity
You agree to indemnify and hold us and (as applicable) our subsidiaries, affiliates, managers, agents and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms and Conditions or your violation of any law or the right of a third party.
5. Interruption of service
Although our server providers are doing their best to provide constant, uninterrupted access to Research is Cool, we cannot guarantee this. We accept no responsibility or liability for any interruption or delay.
6. Placing an advert
After an advert for a job or course is submitted by an advertiser to Research is Cool, the advert is checked by the Research is Cool web administrator and placed on the site within 2 working days. Research is Cool also reserves the right to place the advert on any other relevant website at no extra cost to the advertiser, in order to increase exposure to the advert.
7. Composite/Multiple Adverts
Advertisers are only permitted to post details of one type of job/course in each single advert. It is our policy not to place composite adverts or multiple vacancies as a single job/course, unless they are identical or very similar in nature. We recognise that in cases where projects are flexible this may be difficult to comply with, so in such cases we will make an exception. However, we reserve the right to contact the advertisers in cases where their advert is not in accordance with our policy and ask for permission to split the advert into an advert for each category as is deemed appropriate by Research is Cool. A fee is payable for each advertisement into which the advertiser's submission is split, but this will be discussed with the advertiser before the charge is put in place.
8. Consent to disclose information included in advert
Advertisers placing job or course adverts should note that the details they put into the advert form can be seen by other registered users once the advert is posted on the site. By including this information in the advert form, advertisers are deemed to have given their consent to this information being disclosed to other users of the website, and to have adhered to all conditions in Section 9.
9. Content of adverts
The advertiser agrees to be solely responsible for ensuring accuracy and sufficiency of any job/course advert submitted to Research is Cool. This includes but is not restricted to the advertiser having obtained all necessary consents in respect of the advertisement and ensured that the advert complies with all necessary legal statutory and regulatory requirements including copyright and/or any other right of any third party. Research is Cool reserves the right to refuse to place an advert, or to remove an advert at its discretion in cases where the advert may be of illegal or libellous nature or is otherwise unsuitable for publication.
10. Advert duration
Adverts (job, course or banner adverts) will be kept on the site for the duration selected and paid for by advertisers, starting with the date the adverts are first posted on the site. In the case of banners, this is 2 working days after a banner space is made available. In the case of job or course adverts this is 2 working days after they have been submitted; For example, if an advertiser has submitted an job or course on the 14th January 2008 and has selected a 3-month duration, and the advert is posted by the Research is Cool administrator on the site on the 16th January 2008, the advert will be kept on the site until the 16th April 2008, unless the advertiser has breached these terms and conditions so as to lead to a suspension or termination of the contract (see Section 13).
11. Amending or removing an advert
If an advertisers would like to make changes to an advert at any time during the advertisement period, they can do so by emailing the changes they would like to make to info@researchiscool.com with the word 'amendment' in the subject line and enough details about the advert to allow the administrator to locate the advert quickly. Research is Cool also reserves the right to make minor changes to adverts where necessary. If advertisers would like to remove an advert before the termination of the contract, they can also do this by emailing info@researchiscool.com with 'remove advert' in the subject line. They should note however that they are still due to pay for the duration they had originally selected. Any requests for amendments or removal shall be attended to within 2 working days.
12. Producing banners
If required, Research is Cool can design banners for you for an additional fee. For banners produced by Research is Cool for advertisers, we reserve the right to use these banners in future marketing materials showcasing our range of services.
13. Submitting banners to Research is Cool
Banner spaces on the site are limited, and therefore we have introduced specific policies to regulate banner spaces. If a banners space is available at the time of request, the banner will be checked by the administrator and posted within 2 working days. If a banner space is not available until a later date, the advertisers will receive an email from the web administrator notifying them of the next available date when a banner space will be available. If the advertiser agrees to wait until that next available date, the advertiser will be invoiced and the banner will be posted within 2 working days of that next available date.
14. Price and Payment
The pricing information for placing an advert on the website are set out in the 'pricing information' page on the website. If paying by credit card, payment is processed immediately. If selecting to pay by cheque or BACs, an automatically generated invoice can be printed by advertisers immediately after submitting their advert. This invoice is payable within 30 working days of the date the advert is submitted (which is the same date as the invoice is generated), unless otherwise agreed with Research is Cool at the time when the advert is posted. The invoice date is the date of submitting an advertisement, and not the date when the advertisement is first published on the site. As stated in Section 11, adverts will be posted on the site within 2 working days of their submission date, after being checked by the administrator. In the event of late or non-payment, the conditions noted in Section 15 shall come into force. Moreover, interest at the annual rate of [5] per cent over the base rate at the Bank of Scotland plc will be charged on a daily basis on all monies outstanding after the due date until the actual date of payment (both before and after judgement).
15. Termination and Suspension
Without prejudice to any rights and remedies available to it, Research is Cool shall be entitled to withhold performance of any of its obligations towards the user if any sum owing to Research is Cool shall be unpaid 21 days after the due date for payment without prior agreement with Research is Cool; or if the user shall commit any breach of these terms and conditions. In the event of a suspension of performance due to late or non-payment of advertisement fees, Research is Cool shall be entitled to require, as a condition of resuming performance, the pre-payment of any further advertisement(s).
16. Changes to these Terms & Conditions
These terms may be varied from time to time. Please ensure that you review these Terms & Conditions regularly as you will be deemed to have accepted any changes if you continue to use the site after they have been posted.
17. Governing Law & Jurisdiction
This agreement is governed by Scottish law and you agree to submit to the exclusive jurisdiction of the Scottish courts.
